Welcome to Stichting Het Nieuwe Simplon, hereinafter referred to as Simplon. The following terms and conditions apply to the purchase of a ticket for a concert or other event organized by SIMPLON, a visit to SIMPLON, and the use of our website www.simplon.nl.

GENERAL TERMS AND CONDITIONS FOR SIMPLON TICKETS
1.1 These General Terms and Conditions for Admission Tickets apply to every offer and every agreement concluded between Stichting Het Nieuwe Simplon (hereinafter referred to as: “SIMPLON”) and the person who orders/purchases an admission ticket for an event organized by SIMPLON (hereinafter referred to as: the “customer”). These general terms and conditions also apply if these agreements are concluded via an official (pre)sales organization engaged by SIMPLON for the event in question (hereinafter referred to as: “(pre)sales address”) and via the SIMPLON website.
1.2 In these general terms and conditions, an event is understood to mean (musical) performances and/or other manifestations in the broadest sense of the word.
1.3 In these general terms and conditions, the location where the event is held is understood to mean the actual location of the event as well as all surrounding areas, spaces, fields, etc. that form part of the complex within which the event takes place.
1.4 The applicability of any general terms and conditions of the customer is expressly rejected.
Article 2 – Conclusion of the agreement/admission tickets
2.1 The agreement between SIMPLON and the customer regarding attendance at an event is concluded at the moment the customer orders/purchases a ticket for the event from SIMPLON or a (pre)sales address engaged by SIMPLON.
2.2 An admission ticket may consist of a document issued by or on behalf of SIMPLON or a barcode issued by or on behalf of SIMPLON. The barcode is a unique code.
2.3 The admission ticket is issued once and grants access to one person.
2.4 The admission tickets are and remain the property of SIMPLON. The admission ticket entitles the holder to attend the event. Only the holder of the admission ticket who first presents the admission ticket at the start of the event will be granted access. SIMPLON may assume that the holder of this admission ticket is also the rightful owner (the customer). SIMPLON is not obliged to carry out further checks on valid admission tickets. The customer must ensure that he becomes and remains the holder of the admission ticket provided by SIMPLON.
2.5 From the moment the admission ticket is made available to the customer, the customer therefore bears the risk of loss, theft, damage, or misuse of the admission ticket.
2.6 Only purchases made at authorised advance sales outlets guarantee the validity of the admission ticket. The burden of proof in this regard rests with the customer.
2.7 The admission ticket, which consists of a barcode, will be provided to the customer via electronic communication (e-mail). If the customer has chosen to receive the admission ticket in this manner, the customer must ensure that this admission ticket can be provided via electronic communication and that
it can be provided in a secure manner. SIMPLON cannot guarantee the confidentiality of the admission ticket provided or the receipt of the admission ticket.
Article 3 – Prohibition of resale, etc.
3.1 The customer is obliged to keep the admission ticket for an event for themselves and therefore not to resell it to third parties in any way, offer it for sale, or provide it for commercial purposes. Non-profit resale via Ticketswap is tolerated, but Simplon always reserves the right to invoke the provisions of this article in the event of suspicious transactions.
3. 2 Customers who make their admission ticket available to third parties free of charge and not for commercial purposes are obliged to impose the obligations imposed on them as customers, as set out in the previous paragraphs of this article, on the person to whom they make the admission ticket available and guarantee to SIMPLON that this person or these persons will comply with these obligations.
3.3 If the customer fails to fulfill their obligations as set out in the preceding paragraphs of this article and/or cannot guarantee them, the customer shall owe SIMPLON an immediately payable penalty of €10,000 per violation and €5,000 for each day that the violation has continued and continues, without prejudice to SIMPLON’s right to additionally claim performance and/or compensation from the customer for the damage suffered or to be suffered.
Article 4 – Other obligations of the customer
- Threats, abuse, and other forms of aggression are prohibited. It is also prohibited to engage in sexual harassment, racism, and discrimination.
- The consumption, use, or possession of hard drugs is prohibited. Trade in all narcotics is prohibited.
- The use or possession of weapons is prohibited.
- There is no age limit for concerts.
- The consumption of all alcoholic beverages is prohibited under the age of 18.
- It is forbidden to take our property with you, this also applies to glassware. If our property is damaged, you will be liable for the repair and/or replacement costs.
- It is mandatory to leave bags at the cloakroom. Simplon cannot be held liable for lost property.
- Food and drinks brought from outside may not be consumed.
- Animals are not permitted on our premises.
- Lost property should be handed in to the staff on duty.
- You must follow the instructions of the staff on duty at all times.
- If you have any complaints, of whatever nature, you can report them to the general coordinator of Simplon. Complaints must be reported no later than the next working day. Complaints submitted later will not be dealt with.
- In all cases not covered by the house rules, Simplon staff will decide. These decisions are binding.
Article 5 – Rights of SIMPLON
5.1 In the event of a violation by the customer of one or more of the provisions set out in these general terms and conditions, SIMPLON is entitled to terminate the purchase or to refuse the customer (further) access to the premises without the customer being entitled to a refund of the amount paid to SIMPLON for the admission ticket (including service costs).
5.2 SIMPLON reserves the right to deny the customer (further) access to the premises or to remove them from the location where the event is taking place if SIMPLON deems this reasonably necessary to maintain peace and order during the event.
5.3 If it is plausible that the admission ticket has been forged, SIMPLON is entitled to refuse the holder of this admission ticket (further) access to the premises, without the customer or this holder being entitled to claim any compensation for any damage suffered as a result.
5.4 The artist or (if the artist so requests) SIMPLON is entitled to make or commission visual and/or audio recordings. Persons appearing in the recordings are not entitled to any compensation.

Article 6 – Force Majeure
6.1 In the event of force majeure in the broadest sense of the word, including in this context illness and/or cancellation of the artist(s), strikes, fire, bad weather conditions, etc., SIMPLON has the right to postpone the event to a later date or to cancel the event.
6.2 If the event is cancelled by SIMPLON due to or in connection with force majeure, SIMPLON will only be obligated to refund the customer the amount stated on the ticket, regardless of the price the customer paid for the ticket. Refunds will only be made within twelve weeks of the cancelled date at a (pre-)sales outlet, after the customer presents a valid and undamaged ticket for the (cancelled) event to this (pre-)sales outlet. Service charges or other damages will not be reimbursed. The customer is also not entitled to (replacement) admission to another event.
6.3 If the event is rescheduled by SIMPLON to a different date due to or in connection with force majeure, the ticket will remain valid for the new date. If the customer is unable or unwilling to attend the event on the new date, they are entitled to return their ticket to a (pre)sales outlet for a refund of the fee stated on the ticket, regardless of the price the customer paid for the ticket. This refund will only be made if the customer presents a valid and undamaged ticket to the (pre)sales outlet (within three months). If the event is rescheduled to a later date, the customer is not entitled to a refund of the aforementioned fee if they have not returned the ticket in question to the (pre)sales outlet within four weeks of the rescheduled date of the event. If the event is moved to an earlier date than the one stated on the ticket, the customer’s right to a refund expires if they do not return their ticket to a (pre-)sales outlet within four weeks of the (old) date stated on the ticket. Service charges or other damages will never be reimbursed. The customer is also not entitled to (replacement) admission to another event.
Article 7 – Personal data
7.1 SIMPLON processes personal data of customers and visitors to its websites in accordance with its privacy statement and in accordance with the Personal Data Protection Act.
Article 8 – Final provisions
8.1 Dutch law applies to these general terms and conditions and to any agreement between the customer and SIMPLON.
8.2 All disputes arising from the agreement between SIMPLON and the customer, or any agreement resulting from it, will be settled exclusively by the competent court. SIMPLON reserves the right at any time to designate another legally competent court.
SIMPLON TERMS AND CONDITIONS
SIMPLON has house rules to make your stay in the hall as pleasant and safe as possible. These rules are listed on the website and are displayed at the ticket office and at the entrance to the hall. Anyone who does not comply with these rules may be denied access.
SIMPLON checks age in connection with the sale of alcohol. Alcohol is not sold to persons under the age of 18. For this reason, SIMPLON may check your ID. Always bring your identification with you.
The management reserves the right to search visitors. Anyone who refuses to comply may be denied entry without entitlement to a refund of the admission fee.
If you have any complaints, of whatever nature, you can report them in writing to the management of SIMPLON. Complaints must be reported within three (3) working days of the moment they arise. After that, your “right to complain” expires.
